1. Responsible party
2. Collection, processing and use of data
2.1 General information
Personal data refers to “individual items of data pertaining to personal or material circumstances of a specific or determinable individual (person concerned)” (§ 3 sec. 1 of the German Data Protection Act). For instance, personal data includes name, E-mail address, profile picture or bank details. REBELLE only processes your personal data in accordance with the provisions of the German data privacy laws, in particular pursuant to the data protection regulations of the German Telecommunication Media Act (TMG) and additionally, the German Data Protection Act.
2.2 Automatically collected usage data
Each time this website is used, so-called usage data is recorded in server log files – as is common on the Internet. This usage data is sent automatically by your web browser. Said data consists of the following information:
- IP address (Internet Protocol address) of the computer accessing the REBELLE website;
- Internet address of the website from which the REBELLE website was requested (so-called referrer URL);
- name of the service provider via which access to the REBELLE website takes place;
- name of the accessed files or information;
- date, time and duration of access;
- volume of transmitted data;
- operating system and information regarding the web browser of the computer accessing the REBELLE website;
- http status code (e.g. “request successful” or “requested file not found”).
The aforementioned type of log file information is only stored by REBELLE for a maximum of seven days for security reasons (e.g. to identify hacking attempts) and is then deleted. Data, whose further storage is required for evidential purposes, is excluded from deletion until final clarification of the respective incident. In individual cases, log file information can be disclosed to investigative authorities.
Furthermore, log file information is solely stored and statistically analysed in an anonymous form, to continuously improve this website, to adapt to the users’ interests and to detect or eliminate errors more quickly.
2.3 Use of personal data in connection with registering
A registration is required for purchases and sales via the REBELLE website. The users have two alternative registration options at their disposal:
Users can register on the REBELLE website using a valid E-mail address. The user account is activated as soon as the registration is confirmed from the specified E-mail address.
Alternatively, users can use their Facebook account, to register on the REBELLE website. In this case, REBELLE obtains the user’s Facebook ID, name, profile picture and E-mail address from the user’s Facebook account through Facebook Inc. (1601 S. California Ave, Palo Alto, CA 94304, USA) or Facebook Ireland Limited (Hanover Reach, 5-7 Hanover Quay, Dublin 2, Ireland) (Facebook).
Regardless of the type of registration, REBELLE requires the specification of an (arbitrary) user name, a valid E-mail address, a password as well as a billing and if applicable, delivery address from buyers or sellers, to register on the REBELLE website. When registering, it must also be indicated whether the REBELLE website is to be used for private or professional purposes. Insofar as users provide feedback or comments on the REBELLE website, this information is also stored in the profile.
Furthermore, users can also voluntarily upload a profile picture and other profile information. The user can change all profile data and delete voluntary information at any time.
You can find a description on how to delete your user account in our FAQ.
2.4 Public profile data
Please note that the following information in your profile will be freely accessible to everyone on the Internet: User name, place of invoice, profile picture, feedback and comments as well as items to be sold.
In order to leave comments regarding individual items, the IP address of the author/subscriber is stored. This storage is carried out for the protection of REBELLE in the event that comments made by the author interfere with third party rights and/or illegal contents are posted. A transmission to third parties does not take place.
2.5 Use of personal data in connection with purchases and sales (including payment details)
In particular, REBELLE uses your data for your registration on the REBELLE website, to answer enquiries as well as to process purchases or sales via the REBELLE website to the extent defined in the terms and conditions. The terms and conditions are the General Terms and Conditions of the StyleRemains GmbH for the REBELLE Website and the Special Terms and Conditions of the StyleRemains GmbH for the REBELLE Website – Sellers.
Furthermore, when registering on the REBELLE website, your IP address as well as the date and time of your registration are stored. This is to prevent third parties from misusing your data or using this data to register on our website without your knowledge.
In the currently solely available beta version of the REBELLE website, information pertaining to payment method or bank details (“payment information”) can be voluntarily entered into the user account. Given that purchases via the website are not yet possible in the beta version, the payment information is merely stored; no further processing or use of this data takes place.
2.6 Use of data for advertising purposes; right of objection
Furthermore, REBELLE uses your data collected during the registration for its own advertising purposes to the extent permissible by law (including via E-mail). We also use your data for third party postal advertising to the extent permissible by law. Moreover, we transfer data under a summarised feature (e.g. “buyer handbag”) to selected cooperation partners (only name, address, designation of occupation, sector or trade name, if applicable title and/or academic degree as well as year of birth) for advertising purposes. A further use of your data for advertising purposes only takes place with your explicit consent.
You have the option of objecting to the transfer of your data for advertising purposes or the general use of your data for advertising purposes at any time. To do so, please contact us using one of the contact methods indicated under item no. 8 (e.g. via E-mail).
2.7 Transfer of data to third parties; service providers
In principle, users’ personal data is only transferred to third parties by REBELLE insofar as this is necessary for the purpose of contract implementation or explicit consent was given. Furthermore, data can be transmitted to third parties insofar as REBELLE is obligated to do so based on legal requirements or an enforceable official or judicial order. In the event of an adequate suspicion of infringement (in particular the verification of ownership of rights by an allegedly injured party), REBELLE will transfer information on the identity of a user to the alleged injured party insofar as REBELLE is obligated to do so under applicable law. REBELLE reserves the right to use service providers for the collection and/or processing of data. Service providers only receive personal data from REBELLE, which they require for the specific task. For example, the delivery address can be transmitted to a logistics service provider, to enable said provider to deliver the merchandise purchased via the REBELLE website. Service providers can also be tasked with providing server capacities.
